University Centre Leeds welcomes applications from ex-offenders and considers them on their merits.

You only have to disclose convictions where these are not spent under the Rehabilitation of Offenders Act 1974. A conviction becomes spent after any period of sentence has been completed. A prison sentence of four years or more will never be spent. If you are applying for a course which will involve working with children (under 18) or vulnerable adults then you will have to declare all convictions including cautions and reprimands. These activities are exempt from the Rehabilitation of Offenders Act 1974. Any failure to disclose criminal convictions may result in you being removed from your course e.g. review of your disclosure. You may be required to come in for an interview to discuss your disclosure further.

The length of time it takes to become spent is defined by the Rehabilitation of Offenders Act 1974 and depends on the sentence or disposal made by the court following the conviction. Until that period has passed, the conviction is considered 'unspent' and you must tick the box. Further convictions can impact when other convictions become spent. Sentences of over four years in prison cannot become spent. Most cautions, reprimands and final warnings become spent immediately, so will not normally be 'unspent'. For more information on offences and rehabilitation periods, visit https://www.gov.uk/guidance/rehabilitation-periods

Why do we collect this?

We are required by law to undertake background checks for courses where learners are involved with young people or vulnerable adults. For certain courses, additional information will also be required before we are able to accept you to the course. As an equal opportunities educational organisation, Luminate Education Group is committed to delivery of a learning environment free from prejudice and unlawful discrimination, and that includes on the grounds of criminal convictions.

Please note that failing to complete this section or providing false information may lead to your application/ enrolment being withdrawn. Any information you provide Luminate Education Group in relation to criminal convictions will only be disclosed to third parties if this is necessary in the interests of the safety and welfare of other students or staff.

If you declare that you have an unspent criminal conviction we will contact you for further information. Declaring a conviction will not necessarily bar you from being offered a place at College, however, failure to disclose something which we later become aware of could result in disciplinary action.
